US Lawmakers Move to End Trump’s 50% Tariffs on India

US House Democrats Deborah Ross, Marc Veasey, and Raja Krishnamoorthi have introduced a joint resolution to end former President Donald Trump’s national emergency on India that enabled tariffs of up to 50% on Indian imports. The move is argued to be illegal, abusing emergency powers under the International Emergency Economic Powers Act (IEEPA), hurting US workers and consumers, and damaging the US–India strategic partnership.

The US House resolution aims to terminate the national emergency declared by Trump in August 2025 under IEEPA, which allowed steep tariffs on Indian imports. The resolution also seeks to rescind the additional 25% “secondary” duties imposed on 27 August 2025, taking total duties on many Indian-origin products to up to 50%.

Trump’s tariff actions on India were justified by his team due to India’s purchases of Russian oil, indirectly supporting Moscow’s war effort in Ukraine. However, the three lawmakers argue that this is an abuse of executive and emergency powers and an overreach into Congress’s constitutional authority over trade.

The lawmakers brand the tariffs as “illegal” and say they harm American workers and consumers, disrupt supply chains, and strain long-term US–India relations. Deborah Ross highlights substantial Indian investment and jobs in North Carolina and warns that tariffs put local jobs, innovation, and competitiveness at risk.

The House resolution follows a bipartisan Senate measure to end similar emergency-based tariffs on Brazil, signaling growing cross-party pushback against the use of emergency powers to reset trade policy.

The US India trade relations 2025 have been strained due to these tariffs, with Indian exporters facing one of the sharpest trade shocks in recent years. The US Department of Homeland Security noted that the tariffs apply to products “entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 am EDT on August 27, 2025”.

The lawmakers, including Raja Krishnamoorthi, argue that ending the Trump India tariffs is part of a broader effort by congressional Democrats to reclaim Congress’ constitutional authority over trade and to stop the President from using emergency powers to unilaterally impose his misguided trade policies.
